Nigerian Securities Regulator Looking to Curb Crypto Marketing by Influencers

The Nigerian Securities and Exchange Commission (SEC) is set to enforce new regulations that will restrict social media influencers from promoting digital currencies and exchange platforms in the country. The latest step follows a growing trend of crypto promotion by online influencers who are looking to make a quick buck as the popularity of the digital currency sector rises.

No Objection Certificate Requirement

The largest African economy is now requiring crypto firms including Virtual Asset Service Providers (VASPs) to obtain permission from the top regulator before engaging with a third-party marketing campaign.

Additionally, the third party is also bound to follow the tight guidelines handed out by the SEC. The first step is to obtain a No Objection Certificate (NOC) from the regulator. After that, these fintech influencers will need to declare that they are receiving compensation to promote digital currencies or their trading platforms. Failure to follow these steps can result in a one-million Naira ($6400) fine or a jail time of three years.

The agency has also stated it will actively monitor the situation and punish individuals looking to promote crypto products on social media.

It remains to be seen just how much red tape will be involved in this process or whether the regulator even has plans to allow this activity at all.

Nigerian Government’s Crackdown on Crypto

The move is widely seen as yet another attempt to cool down the explosive growth of the digital currency market in the country. The current Nigerian government has had a troublesome relationship with the digital currency economy.
Earlier this year, it banned all cryptocurrency exchanges in the country after blaming them for a big drop in the national currency’s worth in forex markets. The interaction has been overall hostile ever since with top executives from Binance being arrested in the country and kept under custody for several months. Effectively all trading platforms were banned and forced to undergo a rigorous application process.

A few exchanges including African-origin platforms like Quidax and Busha Digital were eventually allowed in the country after several months of regulatory uncertainty. This action was widely seen as a measure to promote Indigenous African platforms in the country so that the threats of money laundering could be minimized. The top-ranked official of the SEC Dr Emotimi Agama has already hinted that several applicants of the VASP license may be disqualified without naming anyone. The current trend suggests that major platforms like Binance, Coinbase, etc might not get approved in Nigeria for the time being creating a big gap in the market.
